By accessing and using eeV.ai's AI-powered customer care platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.
eeV.ai provides an AI-powered customer care platform that utilizes machine learning and natural language processing to deliver automated customer support across multiple channels including live chat, email, WhatsApp, and phone. The Service processes customer inquiries using your provided knowledge base documentation to generate accurate, contextual responses.
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
You agree not to use the Service to: (a) upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; (b) harm minors in any way; (c) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; (d) upload or transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships; (e) upload or transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; (f) upload or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; (g) upload or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (h) interfere with or disrupt the Service or servers or networks connected to the Service.
You retain all ownership rights to the content and documentation you upload to your knowledge base. By uploading content to eeV.ai, you grant us a limited license to process, store, and analyze your content solely for the purpose of providing the Service. We will not use your knowledge base content to train our models for other customers or for any purpose outside of serving your account. You are solely responsible for ensuring you have the necessary rights to upload and use all content in your knowledge base.
We take data privacy and security seriously. All customer conversations and knowledge base content are encrypted in transit and at rest. We comply with GDPR, CCPA, and other applicable data protection regulations. For detailed information about how we collect, use, and protect your data, please review our Privacy Policy. We will never sell your data to third parties or use it for purposes other than providing and improving the Service.
While we strive to provide 99.9% uptime, we do not guarantee that the Service will be available at all times or that it will be error-free. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. Scheduled maintenance will be communicated in advance when possible.
Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. If you fail to pay any charges when due, we may suspend or terminate your access to the Service. You are responsible for all taxes associated with your use of the Service.
The Service and its original content, features, and functionality are and will remain the exclusive property of eeV.ai and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may not copy, modify, distribute, sell, or lease any part of our Service or software.
To the maximum extent permitted by applicable law, in no event shall eeV.ai, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; (d) unauthorized access, use or alteration of your transmissions or content. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to defend, indemnify, and hold harmless eeV.ai and its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third party right, including any intellectual property right or privacy right; (d) any content you upload to the Service.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time by contacting our support team. Upon termination, we will provide you with an opportunity to export your data within 30 days.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to prevent irreparable harm.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
